End User License Agreement (EULA)

1. Introduction and Acceptance of Terms

This End User License Agreement ("EULA", "Agreement") is a legally binding contract between you (either an individual or a single corporate entity, hereinafter referred to as "Licensee", "You", or "Your") and Wondrhost ("Licensor", "We", "Us", or "Our"). This Agreement governs your acquisition, installation, access, and use of software licenses, authentication scripts, APIs, and related add-ons provided by Wondrhost (collectively referred to as the "Software").

BY PURCHASING, DOWNLOADING, INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE PROVIDED BY WONDRHOST, YOU EXPLICITLY AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. If you do not agree to the terms of this EULA, you must immediately abort the installation process, destroy all copies of the Software and scripts in your possession, and refrain from utilizing our licensing network.

2. Definitions

  • "Software" refers to the third-party server management applications (including but not limited to cPanel, WHM, LiteSpeed, CloudLinux, Imunify360, JetBackup, Virtualizor, Softaculous, Sitepad) and the proprietary Wondrhost authentication scripts, binaries, and API connections used to activate and maintain them.
  • "Shared License" refers to the specific budget-friendly licensing model provided by Wondrhost, which utilizes a centralized authentication network and proprietary scripts to validate third-party software on the Licensee's server.
  • "Server" refers to the single physical or virtual machine, identified by a single primary IPv4 address, on which the Software is installed and authorized to run.

3. Nature of the Software (Shared Licensing Model)

Wondrhost provides specialized, script-based "Shared Licenses" designed to offer premium server software at budget-friendly rates. You explicitly acknowledge, understand, and agree to the following operational realities regarding these licenses:

Important Acknowledgment Regarding Vendor Support:

Because the Software utilizes Wondrhost's shared authentication network, you will NOT receive official technical support directly from the original software developers (e.g., cPanel Inc., CloudLinux Inc., LiteSpeed Technologies). All technical support, bug reports, and troubleshooting requests related to the licensed software must be directed exclusively to the Wondrhost support team.

  • Script-Based Authentication: The Software relies entirely on proprietary scripts and continuous communication with Wondrhost's authentication servers to validate the license status on your Server.
  • Feature Limitations: While Wondrhost strives to provide 100% feature parity with official, direct-from-vendor licenses, certain minor features that rely on direct vendor API connections (e.g., specific vendor-hosted cloud backups or vendor-specific ticketing systems built into the UI) may occasionally be limited, unavailable, or require manual updates via our scripts.

4. Grant of License

Subject to your continuous, strict compliance with this EULA and the timely payment of all applicable recurring subscription fees, Wondrhost grants you a revocable, non-exclusive, non-transferable, non-sublicensable, limited license to install, execute, and use the Software on a single Server (identified by a single registered IP address) owned, leased, or controlled by you.

5. Strict Prohibitions and Restrictions

The license granted herein is strictly limited. You may not, and you may not permit, encourage, or assist any third party to:

  • Reverse Engineer: Decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, or modify the Wondrhost licensing scripts, binaries, or authentication mechanisms in any way.
  • Bypass Security: Attempt to bypass, modify, defeat, spoof, or tamper with the licensing verification process, network checks, or DRM (Digital Rights Management) implemented by Wondrhost.
  • Resell or Transfer: Sell, rent, lease, sublicense, distribute, redistribute, or transfer the Software, the licensing scripts, or your account credentials to any third party. The license is strictly bound to the IP address registered in your Wondrhost client area.
  • IP Spoofing & Network Manipulation: Use IP spoofing, reverse proxies, NAT manipulation, or any network routing techniques to utilize a single purchased license across multiple servers, containers, or unauthorized IP addresses.
  • Remove Notices: Alter, remove, or obscure any copyright, trademark, or proprietary notices embedded within the Software or the Wondrhost scripts.

Consequences of EULA Violation:

Wondrhost employs automated telemetry to detect unauthorized use, reverse engineering, and IP spoofing. Any violation of Section 5 will result in the immediate, permanent, and automated revocation of all your active licenses without prior notice and without refund. Furthermore, your server IP address, associated domains, and account details will be permanently blacklisted from the Wondrhost network, and we reserve the right to pursue legal action for intellectual property theft.

6. Intellectual Property Rights

You acknowledge that the Software, including all associated intellectual property rights (copyrights, trademarks, trade secrets), is the exclusive property of its respective original developers (e.g., cPanel, CloudLinux) and/or Wondrhost (regarding the proprietary authentication scripts and network infrastructure). This EULA does not convey to you any rights of ownership in or related to the Software, but only a limited right of use in accordance with the terms herein.

7. Updates, Maintenance, and Telemetry

Wondrhost regularly provides updates to the Software and licensing scripts to ensure compatibility, patch security vulnerabilities, and maintain stability.

  • Automated Communication: You agree to allow Wondrhost's scripts to communicate automatically with our authentication servers to verify license status, report basic system telemetry (e.g., OS version, script version), and download necessary updates.
  • Firewall Configuration: It is your sole responsibility to ensure that your Server's firewall (e.g., CSF, iptables) allows outbound connections to Wondrhost's designated licensing IP addresses. Failure to whitelist our IPs will result in the Software failing to authenticate and reverting to an unlicensed, locked state.

8. IP Address Management and Changes

Licenses are strictly bound to a specific Server IP address. Wondrhost allows for free IP address changes for your active licenses to accommodate server migrations.

To change the IP address associated with a license, you must log in to your Wondrhost Client Area and utilize the automated IP change tool. Attempting to manually move the script to a new server or IP address without updating the record in the client area will cause the license authentication to fail and may trigger our anti-fraud systems.

9. Audit Rights

Wondrhost reserves the right to periodically audit your use of the Software to ensure compliance with this EULA. This audit is typically conducted via automated, non-intrusive telemetry from our licensing scripts. If an audit reveals that you have violated this EULA (e.g., using one license on multiple IPs simultaneously), Wondrhost may immediately terminate your licenses and seek appropriate legal remedies.

10. Term and Termination

This EULA is effective upon your installation or use of the Software and remains in effect until terminated. Your rights under this EULA will terminate automatically and immediately without notice from Wondrhost if:

  1. You fail to comply with any term, condition, or restriction of this EULA.
  2. You fail to pay the recurring subscription fees associated with the license.
  3. You initiate a chargeback or payment dispute.

Upon termination of the license for any reason, you must immediately cease all use of the Software and permanently delete all copies of the Wondrhost licensing scripts, cron jobs, and binaries from your Server. Wondrhost reserves the right to remotely deactivate, lock, or uninstall the Software upon termination or cancellation of your subscription.

11. Disclaimer of Warranties

THE SOFTWARE, SCRIPTS, AND AUTHENTICATION NETWORKS ARE PROVIDED ON an "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WONDRHOST EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

WONDRHOST DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT ITS OPERATION WILL BE UNINTERRUPTED, VIRUS-FREE, OR ERROR-FREE, OR THAT IT WILL BE COMPATIBLE WITH ALL SERVER CONFIGURATIONS, OPERATING SYSTEMS, OR THIRD-PARTY APPLICATIONS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, RESULTS, AND PERFORMANCE OF THE SOFTWARE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WONDRHOST, ITS AFFILIATES, DIRECTORS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA LOSS, SERVER DOWNTIME, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SOFTWARE OR SCRIPTS.

Under no circumstances will Wondrhost be responsible for any damage, loss, or injury resulting from hacking, tampering, malware infections, or other unauthorized access or use of the Software or your Server. In no event shall Wondrhost's total cumulative liability to you for all damages, losses, and causes of action exceed the total amount you paid to Wondrhost for the specific software license in the one (1) month immediately preceding the event giving rise to the liability.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wondrhost and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of this EULA, your misuse of the Software, or your violation of any rights of any third party.

14. Severability

If any provision of this EULA is held to be unenforceable, invalid, or illegal by a court of competent jurisdiction, such provision shall be modified to the extent necessary to render it enforceable while preserving its intent, and the remaining provisions of this EULA shall remain in full force and effect.

15. Governing Law and Jurisdiction

This EULA and any dispute arising out of or in connection with it shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under this EULA will be brought exclusively in the competent courts located in India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
